Terms of Use

Please read these Terms carefully before using MaltaMoto. By downloading, installing, or using the app you agree to be bound by these Terms. If you do not agree, do not use the app.

1. The Service

MaltaMoto ("the app", "the Service") is a reference tool that aggregates and displays information about motorcycle parking locations in Malta and Gozo. The app allows registered users to record parking visits, report issues, save favourite spots, and create private personal spots.

In addition to the app, we operate a data services business that compiles anonymised, aggregated datasets and related products derived from app activity. These data services are governed by Section 7 of these Terms.

The app is not affiliated with, endorsed by, or operated in conjunction with any governmental authority, transport body, or local council, except where a formal data licensing or partnership arrangement is in place.

2. Eligibility

MaltaMoto is intended for use in Malta by licensed motorcyclists and moped riders. You must be at least 16 years old to use the app, in line with the minimum legal age to hold a motorcycle or moped licence in Malta and Malta's digital consent age under the GDPR. By using the Service you confirm that you meet this requirement.

3. Accuracy of Parking Information

Important: All parking spot data in MaltaMoto, including locations, addresses, capacity descriptions, pricing information, and access notes, is provided for general reference purposes only. We make no representation, warranty, or guarantee of any kind that any spot is:

Parking regulations in Malta change frequently. Spots may be temporarily or permanently closed, converted to other uses, altered in capacity, or made subject to new restrictions at any time and without notice. Community-submitted data, including visit confirmations, busy hours statistics, and issue reports, reflects the experiences of individual users at specific moments in time and may be outdated, inaccurate, or unverified.

You are solely responsible for verifying that any parking location is suitable and legal before parking your vehicle. Always observe applicable road signs, markings, and regulations. Never rely solely on this app when deciding where to park.

4. No Liability for Parking Outcomes

To the fullest extent permitted by applicable law, we disclaim all liability for any loss, damage, fine, penalty, or other adverse outcome arising from your use of, or reliance on, the information provided by MaltaMoto. This includes but is not limited to:

The information displayed in the app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. User Accounts

Accounts are created exclusively through Sign in with Apple or Sign in with Google. We do not store passwords. By signing in you authorise us to receive the profile information provided by your chosen identity provider (see our Privacy Policy for details).

Independently of account creation, the app records a randomly generated installation ID, your device model, and your OS version when you first open the app. If you sign in, this device record is linked to your account. This data is used for statistical and compatibility analysis and may contribute to anonymised data products as described in Section 7.

The app also collects in-app usage events through PostHog, our product analytics service (hosted in the EU), using your installation ID as a pseudonymous identifier. If you sign in, your installation ID is linked to your user ID in PostHog so that usage history can be associated with your account. This data is used to understand how the app is used and to guide improvements. It is not used for advertising or cross-app tracking. We reserve the right to suspend or terminate accounts that violate these Terms or that are used in a manner that is abusive, fraudulent, or harmful to the Service or other users.

6. User-Submitted Content

6.1 Visit Confirmations and Occupancy Data

When you confirm a parking visit or report occupancy, you confirm that the information reflects your genuine experience at that time and location. Submitting false or misleading visit data is prohibited. Visit confirmations contribute to community statistics, may be retained in anonymised form after your account is deleted, and may contribute to anonymised data products as described in Section 7.

6.2 Issue Reports and Photos

When you submit an issue report, including any attached photographs, you grant us a non-exclusive, royalty-free licence to store, display, and use that content for the purpose of operating and improving the Service, including displaying it to MaltaMoto moderators. You retain ownership of your content.

You must not submit content that:

Issue reports may be retained after your account is deleted until a MaltaMoto moderator resolves and removes them. Aggregated, anonymised indicators derived from issue data (such as the frequency or nature of reported problems in a given area) may also form part of our data services as described in Section 7.

6.3 Private Spots

Private parking spots you create are visible only to your account. You are responsible for ensuring that content you store does not violate any applicable law or third-party rights. We reserve the right to remove content that comes to our attention as unlawful.

We may use aggregated, fully anonymised data derived from private spot locations for statistical purposes, such as identifying areas of unmet parking demand. No data that could identify you or your exact private spot will be shared or published.

7. Data Products and Data Licensing

We compile anonymised, aggregated statistical datasets from the collective activity of app users ("Data Products"). Data Products do not contain personal data: they are aggregate metrics, patterns, and indicators that cannot be attributed to any individual user.

By using the Service, you acknowledge and agree that:

We may develop and offer data-related products and services, including but not limited to dashboards, reports, and analytical tools, based on Data Products. The nature and scope of these offerings may evolve over time.

All intellectual property rights in Data Products, including the structure, methodology, and presentation of derived datasets, are owned by us. Licensees receive a right to use Data Products only as specified in the relevant licensing agreement.

9. Navigation and Road Safety

The app integrates with third-party mapping and navigation services, including Apple Maps, Google Maps, and Waze. Navigation instructions are provided by those third parties and are subject to their respective terms and accuracy limitations. We are not responsible for the accuracy or safety of navigation instructions or routes.

Never operate your device while riding. Always park safely before interacting with the app. Comply with all traffic laws and road safety rules at all times.

10. In-App Purchases and Premium Features

The app may offer premium features available through in-app purchase. All purchases are processed through Apple App Store or Google Play and are subject to those platforms' billing terms. Subscription fees are non-refundable except where required by applicable law or the relevant platform's refund policy.

We reserve the right to modify, suspend, or discontinue premium features at any time. Where a feature is removed mid-subscription, we will endeavour to provide a pro-rated credit or alternative, but we are not obliged to do so.

11. Data Retention After Account Deletion

When you delete your account, the following data is deleted within 30 days: your account record, your saved spots, and your private parking spots.

The following data is retained after deletion because it forms part of the shared community dataset: visit confirmations and occupancy data (used to calculate busy hours statistics), and issue reports together with any attached photos (retained until resolved by MaltaMoto). Retained records reference only your anonymous user ID, which cannot be linked back to your identity once your account is deleted.

Anonymised, aggregated Data Products compiled from user activity (as described in Section 7) do not reference individual user records and may be retained and distributed indefinitely.

12. Intellectual Property

All original content in the app, including design, code, graphics, and branding, is owned by or licensed to us. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our written consent.

You acknowledge that your user-generated contributions (visit data, reports, private spot coordinates used in aggregate) may be used by us to improve the Service and to compile anonymised Data Products as described in Section 7. All intellectual property rights in those Data Products vest in us.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty of any kind. We do not warrant that:

14. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with:

Our total aggregate liability to you for any claim arising out of these Terms or the Service, regardless of the form of action, shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless the operator and any affiliates, contractors, and licensors from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

16. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Malta, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malta.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page or by providing an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
